• Engage in illegal activities or promote unlawful acts.
• Upload or distribute malware, viruses, or malicious code.
• Send unsolicited communications or spam.
• Attempt to decompile, reverse engineer, or disassemble our software.
• Use automated scripts, bots, or scrapers to abuse or excessively query our services.
• Launch credential stuffing or brute-force attacks against any system.
• Upload content that infringes upon the intellectual property rights of others.
• Share hateful, harassing, or sexually explicit content.
• Interfere with or disrupt the integrity or performance of the services.

5. AI Services Disclaimer

Some of our tools may utilize Artificial Intelligence (AI) to generate content, analyze data, or provide suggestions.

• Accuracy: AI outputs may be inaccurate, incomplete, or inappropriate. We do not guarantee the correctness of AI-generated results.
• Verification: You are solely responsible for reviewing and verifying any AI-generated content before relying on or publishing it.
• Not Professional Advice: AI tools do not constitute legal, medical, financial, or professional advice.

6. File Upload & Processing

Many of our tools allow you to process text, images, and documents.

• Ownership: You retain full ownership of the files you upload. We claim no ownership over your data.
• Permission: You must only upload files that you have the legal right to use and process.
• Local vs Server Processing: Whenever possible, tools are designed to process files locally in your browser. For tools requiring server-side processing, files are used solely to provide the requested service and are automatically deleted shortly after processing.

7. Intellectual Property

Excluding your uploaded content, all materials on OrbitaTools—including the branding, logo, website design, underlying code, icons, graphics, and documentation—are the intellectual property of OrbitaTools or our licensors and are protected by copyright and trademark laws. You may not copy, modify, or distribute our intellectual property without express written permission.

8. Third-Party Services

OrbitaTools integrates with various third-party services to provide core functionality, including but not limited to:

• Google (Authentication & Analytics)
• Stripe (Payments)
• Cloudflare (Edge networking and security)
• Clerk (User authentication)
• Various AI model providers

Your use of our platform may also be subject to the terms and privacy policies of these respective third-party providers.

9. Privacy

Your privacy is critically important to us. Our data collection, usage, and sharing practices are detailed in our Privacy Policy. By using our services, you consent to the practices described therein.

10. Payments & Subscriptions

While our core tools are free, we may offer premium features, credits, or subscriptions.

• Billing: Paid plans are billed in advance on a recurring basis. All fees are non-refundable unless required by law.
• Renewal: Subscriptions automatically renew unless canceled prior to the end of the current billing cycle.
• Cancellation: You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of the current billing period.

11. Service Availability

We strive for high uptime, but we do not guarantee uninterrupted access. We reserve the right to modify, update, temporarily suspend, or permanently discontinue any part of the service at any time, with or without notice.

We make no warranties, expressed or implied, and explicitly disclaim any warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the services will be error-free or completely secure.

13. Limitation of Liability

To the maximum extent permitted by law, in no event shall OrbitaTools, its founders, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of your access to or use of, or inability to access or use, the services.

14. Indemnification

You agree to defend, indemnify, and hold harmless OrbitaTools and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your violation of these Terms or misuse of the services.

15. Termination

We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the service will immediately cease.
